Order
1650 presents a blank check
for the military to use to deport or forcibly transfer from the west
bank anyone they see fit, in accordance with changing policies and
political situations. As such, the order must be viewed as illegal,
regardless of how it is being implemented now, with heavy
international spotlight currently placed on the issue.

35,000 Palestinians Under Threat of Forcible Transfer to Gaza - Hamoked
Dear Colleagues,
HaMoked has received
a response to its petition under the Freedom of Information Act for figures of
Palestinians forcibly transferred to Gaza on the basis of their registered
address, and those who may be considered at high risk for forcible transfer under
the new orders. The full translated document is attached, but in short, it
shows that nearly 35,000 individuals must be viewed as being at high risk:

1. We seek to recall that on March 25, 2010, we appealed in letter to the military commander regarding the Orders in reference, prior to their taking effect. There we raised our concerns regarding the wording of the Orders, in particular the expansive definition of "infiltrator" and the custody and deportation proceedings. We therefore requested to delay their taking effect, to allow for evaluation of our comments.

served a petition to the HCJ, along
with 15 other Israeli and Palestinian human rights organizations,
regarding the practice of expulsion of Palestinians from the West
Bank to the Gaza Strip solely on the basis of their registered
address.

Yesterday two military orders came into
effect which define, for the first time since the occupation of the
oPt in 1967, Palestinian residents of the Occupied Territories as
“infiltrators” or “illegal aliens” in their land and in their
homes.

1. I hereby appeal to you regarding the orders cited in the heading which were signed on October 13, 2009 and are due to come into effect on April 13, 2010. These orders substantially alter the law regarding any person currently present in the West Bank, and, regrettably, prior to their signing no public debate allowing for input by actors outside the military, including human rights organizations such as HaMoked: Center for the Defence of the Individual was held. In the time that has passed since the orders were signed, we have studied their provisions and we now wish to present you with our comments, before the orders come into effect.
